United Steelworkers of America v. Kiewit Continental, Inc. and Continental Can Co.

 

The United Steelworkers alleged that Kiewit, a can manufacturer, used an elaborate scheme to deprive union members of pension benefits. After a bifurcated trial produced a liability verdict against the defendant, the judge ordered an evidentiary hearing to determine damages. The union hired AEP to analyze and refute Kiewit's arguments that no damages could be awarded because certain events, such as layoffs and plant closings, would have occurred despite the scheme. AEP's rebuttal testimony was a critical factor in the $415 million damages verdict in favor of the union.


 

Statistical Analysis of Pacific Bell Telephone Company Employees' Overtime Hours   AEP performed a statistical analysis that showed Pacific Bell Telephone Company lacked proper data to refute the testimony of employees on the number of overtime hours worked. The case settled after AEP provided testimony in settlement talks that demonstrated the data were unreliable.
     
Sugarcane Workers v. Sugarcane Manufacturers
  AEP was asked to undertake a statistical analysis of data to determine if a large processor of sugar had violated federal regulations on the number of hours worked and by falsifying data. AEP's analysis showed that Jamaican sugarcane workers had not been paid, as required by the contract permitting their entry into the United States; and that the company had falsified data, making discovery of the violations more difficult.
