AEP has demonstrated a unique ability to understand and apply economic principles to problems involving pharmaceutical or chemical products and industries. In addition to the application of economics and damages analysis to these complex technologies, these cases often involve antitrust and intellectual property issues.

Representative Assignments:

Developer of Synthetic Protein Technology v. Biopharmaceutical Manufacturer

AEP prepared a damages study for a developer of synthetic protein technology in connection with a biopharmaceutical manufacturer's failure to perform a licensing agreement for using the technology for protein synthesizers and protein sequencers.

DuPont v. Abbott   DuPont sued Abbott for patent infringement with respect to monoclonal immunoassay technology. AEP performed a damages analysis that was based in part on a survey of laboratory purchasers of assay equipment.

AlliedSignal v. Atochem   In conjunction with another consulting firm, AEP personnel performed an economic analysis on behalf of AlliedSignal's chemical division in its arbitration claim against Atochem, a large French chemical manufacturer. The analysis quantified damages because Atochem had breached a technology sharing agreement by acquiring AlliedSignal's largest competitor in the United States.

Hematronix v. Coulter Corp.   Hematronix, a manufacturer of reagents and chemicals used in hematology testing equipment, filed an antitrust action against Coulter, one of the largest hematology testing equipment manufacturers, for monopolization of the market for reagents and other consumable chemicals used in hematology testing equipment. AEP prepared a detailed analysis of antitrust liability as well as an economic analysis of damages on behalf of Hematronix. The case settled after AEP filed its expert report.
